Terms of Business
These terms apply to all business transacted whether regulated mortgages, unregulated mortgages commercial mortgages or secured loans.
1. Brilliant Loans;
1.1 Carries out no activities regulated by the Financial Services Authority and is not authorised to carry out such activity.
1.2 Accepts no responsibility for the general compliance of the Introducing Intermediary or the compliance of an individual mortgage or loan application.
1.3 Accepts no responsibility to applicants or borrowers for the activities, information or advice given by the introducing intermediary.
1.4 Will require the Introducing Intermediary to provide a copy of a valid Consumer Credit Licence.
1.6 Reserves
a) the right to take additional references,
b) the final decision on the acceptance of an application.
c) the right to withhold the payment of fees to the introducing intermediary if any of the requirements of these terms are breached or if any sums are owed by the Introducing Intermediary to Brilliant Loans.
1.7 Is unable to release confidential information obtained as a result of enquiries made during the processing of applications.
2. Introducing Intermediaries
2.1 Must comply with the Consumer Credit regulations without exception.
2.2 Must immediately inform Brilliant Loans of;
a) any change in or withdrawal of its Consumer Credit Licence,
b) any disciplinary proceedings or investigation by any other regulatory body.
2.3 Is not authorised to use the name, brand or any name or brand that might be reasonably taken for the Brilliant Loans name or brand without the prior permission of Brilliant Loans.
2.4 Must comply with the requirements of the Data Protection Act 1998.
2.5.1 Must comply with Money Laundering regulations, guidelines and directives applicable to the business transacted.
3. Business is transacted under the following terms.
3.1 All forms and supporting documentation must be completed legibly, truthfully and in full.
3.1 The production and issuing of any other regulatory documentation in a compliant and accurate form is the responsibility of the Introducing Intermediary
3.2 Brilliant Loans relies on the Introducing Intermediary to ensure that all information in respect of any aspect of an application is without exception correct, true and accurate.
3.3 Brilliant Loans assumes that the applicant has agreed to and is fully aware of the submission of the application to Brilliant Loans.
3.4 The Introducing Intermediary confirms that the applicant understands the full implications of the transaction.
3.5 The Introducing Intermediary confirms that the applicant has signed, understands and approves of all of the information and declarations in the Application Forms and other documents before submission to Brilliant Loans.
